Preliminary ruling procedure and family reunification rules in the EU Term Paper
Preliminary ruling procedure and family reunification rules in the EU - Term Paper Example is no provision for family re-unification with children, and the best relief that Cathy can get is applying for help at the European Court of Justice. In her application, Cathy argued in terms of the right of free citizenship movement, and the family re-unification directive. However, the tribunal the local tribunal sought an application to the European Court of Justice seeking to identify whether these directives over rule the New Caledonian Law. In analyzing the freedom of freely moving, and whether the application of this law in New Caledonia amounts to overruling their laws, it is essential to define citizenship (Kochenov, 2012). Under article 17 (1) of the European Union laws, a citizen of the European Union is a person who has the citizenship of a state under the European Union. Section 12 of the amended European Commission treaty provides for certain rights to citizens of the European Union, and amongst them includes the right of non-discrimination, and this applicable within the provisions of the treaty. Article 18 of the amended EC treaty gives individuals the right of free movement within memberââ¬â¢s states, but under some limitation. This right of free movement is limited to the spouse, and to their children. In the case involving the Home Department secretary of State, against Chen Lavette, the European Union Court of Justice ruled that a European Union Citizen, has the right of residing in member states of the European Union, and this right does not contravene the laws of the member state (Sawyer and Blitz, 2011). In the case law, Catherine Chen was born in Northern Ireland; and therefore entitled to receive the Irish Citizenship. Mrs. Chen obtained an Irish passport for her, with the intention of using her childââ¬â¢s status to reside in Wales. However the British authorities refused to grant her residency permit. The British authorities sought guidance from the European court, and it made a decision favorable to Mrs. Chen (Wiesbrock, 2010). The ECJ

Analyse the ways in which sociologist point to the social nature of Essay
Analyse the ways in which sociologist point to the social nature of living with cancer as a teenager - Essay Example This is the moment that human beings use to plan for their future lives and school life. It is also the most vibrant stage in the human lifecycle because teenagers experience major changes in their bodies and they discover who they are i.e. their personality traits, likes and dislikes. Teenagers are also highly active and interactive thereby developing a large social network. However, this is not always the case with teenagers suffering from cancer. The diagnosis, treatment and management of cancer greatly interfere with the activities of this critical growth stage (Wawsczczyk 2005). According to sociologists this is the stage in life where teenagers learn to be independent from their parents and family members thereby focusing more on their future. However, this is not possible for teenagers suffering from cancer because they need utmost support, attention and care from their parents and family members for emotional, psychological and social support. Therefore, such teenagers are taken a step back from discovering their independence, potential, strengths and weaknesses (Kleinman1988). Also the school life, social life and employment are put on hold for an unknown period of time, which is in contrast to what should be happening in their lives. This is because they become isolated from their peers, adults and school; which is an important social setting for a childââ¬â¢s growth. Cancer treatment is too severe for them to concentrate in school work or find lenient jobs that are conducive to their state of health. It is also quite common for insurance companies to cancel insurance policies for such teenagers because they are not in school. Insurance companies demand that all children still living under the care of their parents should be attending school to enjoy the benefits of the life insurance policies taken by their parents (Wawsczczyk 2005). Various surveys and research conducted by sociologists

Holistic Nursing Research Paper Example | Topics and Well Written Essays - 1500 words
Holistic Nursing - Research Paper Example The term complementary is preferred because it conveys the idea that these therapies are used together with, rather than as a replacement for biomedical treatment. On the other hand, the term alternative conveys the thought of a therapy being used in place of a biomedical treatment. Finding a good definition for complementary therapies has been an uphill task. Several definitions have been proposed. The complementary therapy is a broad area of medicine that is made up of health systems, practices and modalities plus their accompanying beliefs. In the definition, the term complementary medicine is used n place of complementary therapies. However, the word ââ¬Å"medicineâ⬠can be changed to ââ¬Å"therapiesâ⬠. There are more than 1700 identified complementary therapies. Classifying these therapies is as daunting as coming up with their definition. This is because the therapies vary and they encompass indigenous cultural practices that are vastly unknown in the western world. Additional challenges come up because the mechanisms of action for many complementary therapies are not known (Lange & Zahourek & Mariano 2013). NCCAM has suggested the following groups for complementary therapy: biological based therapies, mind-body therapies, manipulative and body-based therapies and energy therapies. NCCAM has noted that a complementary therapy is no longer classified as a complementary therapy once it becomes an accepted treatment for specific conditions (NCCAM, 2005). The boundaries between complementary therapy and the dominant health care systems keep changing. As a result, what may be considered as complementary at a point in time can be recognized as part of the mainstream healthcare later on . Complementary and alternative therapies are healthcare topics that have instigated discussion and debate in a large way. Many people in the US have shown considerable interest in these topics. This is evident

Crazy Eddie Case Study Example | Topics and Well Written Essays - 250 words
Crazy Eddie - Case Study Example Internal auditors are responsible for fraud at Crazy Eddie as they are the ones committing and concealing fraud to both external auditors and the general public (Buchholz, 2011). . The computations above do not indicate any problem at Crazy Eddie. The gross margin ratio of 24%, though it might not be conclusive, shows that the company is operating a healthy business and might be able to service its operating expenses. The inventory turnover ratio too, indicates that the company turnover is high and hence healthy at 482%. 2. There were several barriers to independence at Crazy Eddie. Auditors at Crazy Eddieââ¬â¢s case were not able to detect fraud due high-level fraud cover up from suppliersââ¬â¢ side to its consumers. Fraud occurred on many fronts; liabilities and expenditures, asset valuations, fictitious revenue, disclosures and accounting period differences. Liabilities and expenses were concealed like unpaid bills wouldnââ¬â¢t be declared and paid in the next financial year of held for long periods. Accounting periods would not be cut off at regular intervals in order to add good sales occurring after what should have been a closed book, to inflate revenue falsely. On assets, some were overvalued or the company employed tricks like borrowing the merchandise that would not be paid for immediately. They also used to ship stock from one store to another as auditing was spread out in stores hence double-counting (Knapp, 2013). 3. If I were a partner to audit Crazy Eddie, I would accept to audit this company thoroughly as it was a family entity with all management positions reserved for family members. This was one sign of some weakness as family members can manipulate accounting procedures, and lack of proper conduct can be compromised. Very important too, was the fact that this company was characterized by hype about its success. The crazy hype should be a

HRIS Essay Example | Topics and Well Written Essays - 750 words
HRIS - Essay Example This problem could potentially affect all areas of business for many companies. 2. The reason why so many organizations found themselves vulnerable to the Y2K bug is because they were not disciplined when it came to phase containment. The problem was not only a result of initial legacy systems; many replacement custom systems simply replicated or converted the old programming logic without fixing them. Along with a company's unwillingness to research to find a true fix to the problem, many waited too long and were left rushing to find a solution. The warnings of experts and futurists only added fire to the alarm felt by already panicked companies as many turned to extremely expensive quick fixes. Many of these quick fixes ended up costing billions more than if companies had simply stayed disciplined to phase containment from the beginning. 3. Phase containment can be maintained by acting immediately to any kind of problem as soon as it presents itself. The term "pay a little now, or a lot later" should be applied to every aspect of business along with the realization that even if a maintenance cost may seem expensive at the time, it will end up saving money in the long run. Keeping in close contact with employees and everyone who uses the HRIS software can help keep everyone aware of problems as they present themselves. Part B. 1. Based on the out of date process detailed in figure 4.5 many changes can be made. There are many manual processes required for this HR model and as research has proven manual processes often contain large amounts of human error. By analyzing the current system, businesses can evaluate "where they are now" and what can be done to improve their system. For example a business may use interviews, focus groups, or surveys to help assess their system to see what aspects can be streamlines or eliminated. Looking at Figure 4.5 it may be seen that instead of manually filling out a time card each day, employees could clock in and out with a computer or their hours could be paid through a salary system to avoid any miscalculations, unreadable written information, or typos. The company could download a kind of fact checking system to make sure that the hours employees clocked in and out for were properly documented, eliminating the need for a payroll assistant. By setting up a salary system, there would be no need to hire anyone to calculate payroll, because it would be the same amount of money every time. Then, if an employee notifies payroll of a mistake there will be no need to have to go in and manually recheck what was entered because it would all be electronically calculated. 2. Based on the Hacket Best Practices Benchmark Study of Human Resources' estimate that $17 is wasted in every manual HR transaction this new process can save a company a fortune. If every step in the 6 step model represents a transaction then the company could potentially be wasting $102 for each employee whose payroll they process. With the new improved system the company could save all of this money by eliminating unnecessary transaction steps. If a company pays 10,000 employees once a month, they would save 1,020,000 per month and 12,240,000 per year. 3. Overall, based upon my analysis of this
